BILJANA PLAVSIC ON PROVISIONAL RELEASE

Today, Thursday 6 September 2001, Biljana Plavsic, travelled to the Republic of Serbia after being granted provisional release by Trial Chamber III consisting of Judge May (Presiding), Judge Robinson and Judge Fassi Fihri, on 29 August 2001 (see update no. 186).

Background

Having voluntarily surrendered to the custody of the Tribunal on 10 January 2001, Biljana Plavsic pleaded "not guilty" to all counts charged against her at an initial appearance hearing which took place on 11 January 2001.

On 23 February 2001, the Trial Chamber granted the prosecution motion for joinder of the Krajisnik case to the Plavsic case, filed on 23 January 2001. A consolidated indictment was filed by the prosecution on 9 March 2001.

Provisional release of Plavsic

A hearing was held on 1 August 2001 at which the Government of the Netherlands, the Registrar of the Tribunal and the parties to the motion for provisional release, filed by Plavsic on 11 July 2001, were heard. During a further hearing on 29 August 2001, noting that there was no longer a dispute between the parties as to the provisional release of Plavsic, and being satisfied by
the guarantees given by Mr. Vladan Batic, the Serbian Justice Minister, the Trial Chamber ordered that the accused be provisionally released to reside in the Republic of Serbia until she is ordered to return to The Hague. No trial date has yet been set.
