BLAGOJE SIMIC GRANTED PROVISIONAL RELEASE


Today, 21 October 2004, the Appeals Chamber consisting of Judge Güney (Presiding), Judge Pocar, Judge Shahabuddeen, Judge Schomburg and Judge Weinberg de Roca granted in part Blagoje Simic’s Motion for Provisional Release subject to certain specific terms and conditions set out in the Decision.


On 17 October 2003, Blagoje Simic was sentenced to 17 years’ imprisonment by Trial Chamber II having been convicted of crimes against humanity (persecutions). The Appeals Chamber is currently seised of Blagoje Simic’s appeal against the Trial Chamber’s judgement.


In his Motion, filed 29 September 2004, Simic requested permission to attend memorial services marking the 40-day anniversary of his father’s death.


Pursuant to Rule 65(I) of the Rules of Procedure and Evidence, the Appeals Chamber ordered that Blagoje Simic be provisionally released for a fixed period from 4 November 2004 to 7 November 2004 under the terms and conditions outlined in its Decision.
