I, Wolfgang Schomburg, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal") and Pre-Trial Judge in these proceedings,

BEING SEISED of the "Prosecution’s Motion for Leave to File Late Part of Statement of Expert Witness Rick Butler", filed on 31 October 2002 ("Motion");

NOTING that at the last Status Conference on 19 July 2002 the two parts of the Butler report, including the supporting documents, were ordered to be filed by the end of October;

NOTING that the Motion asks for a delay of one day for the filing of the second part of the Butler report, i.e. on 1 November 2002, and a delay of 15 days for the filing of the accompanying supporting material, i.e. on 15 November 2002;

NOTING that the Motion argues that the delay is caused by the size of the documents involved;

CONSIDERING that a delay in the filing of the report and the supporting material would impact on the preparation of the Pre-Trial Briefs of the Defence which were ordered at the Status Conference to be filed by 25 November 2002;

CONSIDERING that good cause has been shown by the Prosecution that some delay in the filing of the documents is required;

PURSUANT TO Rule 54 and 127 of the Rules of Procedure and Evidence;

HEREBY ORDER that

  1. The Prosecution is allowed to file the second part of the Butler report on 1 November 2002;
  2. The Prosecution is required to file the supporting material for the report by 11 November 2002;
  3. The Defence is required to submit their Pre-Trial Briefs by 10 December 2002.
