TRIAL CHAMBER II ("the Chamber") of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the Tribunal"),

BEING SEIZED OF the "Accused Obrenovic’s Motion for Provisional Release" ("Motion"), filed on 11 June 2002;

NOTING the "Prosecution Response to Request for Provisional Release for Accused Obrenovic", filed on 25 June 2002;

HAVING BEEN INFORMED that the Accused Blagojevic intends to file a Motion for Provisional Release on Wednesday 17 July 2002;

CONSIDERING that, in the determination of this matter, it would be of assistance to seek certain clarifications on the guarantees received from the accused by an authorised senior Representative of the Government of Bosnia and Herzegovina;

CONSIDERING the mandate of the Office of the High Representative in Bosnia and Herzegovina;

NOTING that on Thursday 21 March 2002, a further appearance and Status Conference took place for the Accused Vidoje Blagojevic, Dragan Obrenovic and Dragan Jokic;

NOTING that on Wednesday 3 April 2002, an initial appearance took place for the Accused Momir Nikolic;

PURSUANT TO Rules 54, 65 and 65 bis;

HEREBY ORDERS:

  1. that a Status Conference will be held on Friday 19 July as of 14.15 hours in relation to the accused in this case;
  2. that this Conference will be immediately followed by a hearing on the motion for provisional release by the Accused Dragan Obrenovic and by a hearing on the expected motion for provisional release by the Accused Vidoje Blagojevic;
  3. that a Representative of the Government of Bosnia and Herzegovina will attend the hearing relating to the motion for provisional release by the Accused Dragan Obrenovic and the Accused Vidoje Blagojevic; and

REQUESTS the Registrar to forward this Order to the Office of the High Representative in Bosnia and Herzegovina.
