THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

BEING SEIZED OF a "Defendant Ivica Marijacic’s Motion for Leave to Clarify Answer to Question Posed by Judge Bonomy in Closing Arguments" filed on 23 January 2006 by the accused Ivica Marijacic ("Motion"), in which counsel for the accused Marijacic seeks leave from the Chamber to supplement his answer to a question put to him during trial proceedings on 19 January 2006,

CONSIDERING that the "clarification" submitted by counsel for the accused Marijacic does not alter the Chamber’s understanding of the position taken by Marijacic,

CONSIDERING FURTHER that it is inappropriate for counsel to make further submissions on questions discussed during a trial following the close of trial proceedings,

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the International Tribunal,

HEREBY DENIES the Motion.
