1. 1 Tuesday, 15th June, 1999

    2 (Open session)

    3 --- Upon commencing at 2.05 p.m.

4 JUDGE JORDA: Please be seated.

5 Mr. Registrar, have the accused brought in, please.

    6 (The accused entered court)

7 JUDGE JORDA: Good afternoon to the

8 interpreters. I want to be sure that they hear me.

9 Good afternoon. Good afternoon as well to Prosecution

10 counsel and to Defence counsel. Good afternoon to the

    11 accused.

12 Without any further ado, I give Mr. Hayman

13 the floor who, if I have understood correctly, says

14 that there are not going to be three character

15 witnesses but two today. Mr. Hayman?

16 MR. HAYMAN: Good afternoon, Mr. President.

17 Good afternoon, Your Honours. We do have two character

18 witnesses here. We would like to proceed with them.

19 They are being presented pursuant to the Court's

20 directive that the so-called "Sentencing phase" is to

21 occur concurrent with the trial phase itself, so it is

22 our understanding that for purposes of these witnesses,

23 we are in the "Sentencing phase" of the proceeding.

24 These witnesses, Mr. President, both of them

25 reside in Sarajevo, and they have asked to testify in

  2. 1 closed session today. We hope that doesn't present any

    2 problems.

3 JUDGE JORDA: Let me consult my colleagues.

4 Does that cause a problem for the Prosecution?

5 MR. HARMON: Good afternoon, Mr. President,

6 Your Honours. It does not. Thank you.

    7 (Trial Chamber confers)

8 JUDGE JORDA: Very well. Since it doesn't

9 cause any difficulties, we'll move into a closed

    10 session.

11 MR. HAYMAN: Perhaps also, Mr. President, we

12 could assign pseudonyms to them for purposes of

13 citation to the record in that it may be possible to

14 cite to them in the record without identifying them and

15 yet in an open pleading.

16 JUDGE JORDA: Mr. Registrar -- first of all,

17 we're going to move into a closed session. Closed

    18 session.

19 THE REGISTRAR: That is what I understood.

20 JUDGE JORDA: Yes, it will be a closed

    21 session.
