ORDER ON THE DEFENCE MOTION FOR PROVISIONAL RELEASE

TRIAL CHAMBER I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal");
BEING SEIZED of the Defences "Motion for Provisional Release" (the "Motion") and the Defences "Statement on Motions" in support of the Motion, both dated 7 April 2000 and filed on 13 April 2000, in which the Defence requests that the accused be provisionally released, pursuant to Rule 65 of the Rules of Procedure and Evidence (the "Rules"), and further requests that an evidentiary hearing be held to address the issue;
NOTING the "Prosecutors Response to the Defence Motion for Provisional Release", dated and filed on 20 April 2000, in which the Prosecution submits that the Motion should be denied since the conditions of Rule 65 of the Rules have not been fulfilled;
CONSIDERING that the Defence has not made any substantive argument in support of its Motion, but that in the Statement on Motions it submits that at the requested evidentiary hearing it intends to present evidence "so that the accused can prove that he will appear for trial, if released, and will not pose a danger to any alleged victim, witness or other person";
PURSUANT to Rule 65 of the Rules,
FOR THE FOREGOING REASONS,
ORDERS that on Thursday, 18 May 2000, at 5:00 P.M., a hearing will be held, during which the parties are to present their arguments on the Motion.
