Prosecutor v. Ante Gotovina

DECISION

THE DEPUTY REGISTRAR,

NOTING the Statute of the Tribunal ("Statute") as adopted by the Security Council under Resolution 827 (1993), and in particular Article 21 thereof;

NOTING the Rules of Procedure and Evidence ("Rules") as adopted by the Tribunal on 11 February 1994, as subsequently amended, and in particular Rules 44, 45 and 62(B) thereof;

NOTING the Directive on the Assignment of Defence Counsel ("Directive") as adopted by the Tribunal on 28 July 1994, as subsequently amended, and in particular Articles 14(A) and (B) thereof;

NOTING the Code of Professional Conduct for Counsel Appearing Before the International Tribunal (IT/125 REV.1) ("Code of Conduct");

CONSIDERING that Mr Ante Gotovina ("Accused") was transferred to the seat of the Tribunal on 10 December 2005, and that his initial appearance was held on 12 December 2005;

CONSIDERING that pursuant to Rule 62(B) of the Rules, the Registry assigned Mr Gert-Jan Knoops as duty counsel to the Accused for the purpose of representing the Accused at his initial appearance and in such other matters as may be necessary until the admission of permanent counsel pursuant to Rule 44(A) of the Rules, or the assignment of permanent counsel pursuant to Article 11(B) of the Directive;

CONSIDERING that on 14 December 2005, the Accused executed a power of attorney in favor of Mr Luka Misetic, an attorney from the United States, and that the power of attorney authorizes Mr Misetic to represent the Accused in case IT-01-45 before the Tribunal;

NOTING Mr Misetic’s obligations under the Statute, the Rules (in particular Rule 44(C)) and the Code of Conduct;

HEREBY DECIDES pursuant to Rule 44(A) of the Rules, to admit Mr Misetic to represent the Accused before the Tribunal, in case no. IT-01-45;

DECIDES that the assignment of Mr Knoops as duty counsel ceases as of the date of this decision;

DIRECTS Mr Knoops, in accordance with his duty under Article 9(D) of the Code of Conduct, to hand over to Mr Misetic any case-related materials he received during his assignment as duty counsel.
