I, Carmel Agius, Presiding Judge of Trial Chamber II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal");

NOTING the Indictment in the case of Prosecutor v. Ante Gotovina, kept under seal and confirmed by Judge Fouad Riad on 8 June 2001;

NOTING the Amended Indictment in the case of Prosecutor v. Ante Gotovina, kept under seal and confirmed by Judge Kevin Parker on 24 February 2004;

NOTING the "Order Lifting the Seal on Amended Indictment, Decision on Leave to Amend Indictment and on Confirmation of Amended Indictment and Order of non-Disclosure, and Warrant of Arrest" by Judge Kevin Parker dated 8 March 2004 lifting the confidentiality of the Amended Indictment against Ante Gotovina;

NOTING that Ante Gotovina was transferred to the seat of the Tribunal on 10 December 2005;

NOTING the Order issued on 9 December 2005 by the Vice-President of the Tribunal, acting on behalf of the President of the Tribunal, assigning the case against Ante Gotovina ("Accused") to Trial Chamber II;

PURSUANT TO Rule 64 of the Rules of Procedure and Evidence of the Tribunal;

HEREBY ORDER the detention on remand of the Accused and enjoin the Commanding Officer of the United Nations Detention Unit in The Hague to detain the Accused until further order.
