I, Carmel Agius, Presiding Judge of Trial Chamber II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal");

NOTING the Indictment in the case of Prosecutor v. Ante Gotovina, kept under seal and confirmed by Judge Fouad Riad on 8 June 2001;

NOTING the Amended Indictment in the case of Prosecutor v. Ante Gotovina, kept under seal and confirmed by Judge Kevin Parker on 24 February 2004;

NOTING the "Order Lifting the Seal on the Amended Indictment, Decision on Leave to Amend Indictment and Confirmation of Amended Indictment and Order for Non-Disclosure, and Warrant of Arrest" issued by Judge Kevin Parker on 8 March 2004 lifting the confidentiality of the Amended Indictment against Ante Gotovina;

NOTING that Ante Gotovina was transferred to the seat of the Tribunal on 10 December 2005;

NOTING the Order issued on 9 December 2005 by the Vice-President of the Tribunal, acting on behalf of the President of the Tribunal, assigning the case against Ante Gotovina ("Accused") to Trial Chamber II;

NOTING the Order of 12 December 2005 designating myself as judge of Trial Chamber II for the purpose of the initial appearance of the Accused;

NOTING that the initial appearance of the Accused has been scheduled for Monday 12 December 2005 at 12.45 in Courtroom III;

HAVING CONSIDERED the request of certain members of the press;

PURSUANT TO Rule 81(D) of the Rules of Procedure and Evidence of the Tribunal;

HEREBY ORDER that, subject to any further order of the Trial Chamber:

  1. the taking of still photographs by designated press photographers at the commencement of all proceedings in this matter is authorised as directed by the Chief of Security of the Tribunal’s Security Service; and

  2. the release of the audio-visual record of all open sessions in this case is permitted as provided by the Registrar of the Tribunal.
