 2                           [Open session]

 3                           [The accused entered court]

 4                           --- Upon commencing at 9.14 a.m.

5             JUDGE ORIE:  Good morning to everyone in and around the

 6     courtroom.

7             Madam Registrar, would you please call the case.

8             THE REGISTRAR:  Good morning, Your Honours.  This is case number

9     IT-06-90-T, the Prosecutor versus Gotovina et al.

10             JUDGE ORIE:  Thank you, Madam Registrar.

11             For the sake of transparency, the Chamber would like to put on

12     the record what was done in preparation for the testimonies -- testimony

13     of the Chamber witness, number 3.

14             The steps taken, with regard to calling Witness CW-3 were the

15     following.  On the 26th of February, 2010, a legal officer of the Chamber

16     contacted Witness CW-3 by phone and informed him about the Chamber's

17     decision and about the possible date for testimony.  This telephone

18     conversation was recorded, with the knowledge of the witness, and may be

19     provided to the parties should any dispute arise about what was said

20     during this telephone conversation.

21             I would also like to put on the record that, on the 3rd of March,

22     the Chamber granted the Prosecution's request to send a Request for

23     Assistance to Croatia for Witness CW-3, to the extent that the Request

24     for Assistance did not require Croatia to contact Witness CW-3 regarding

25     the substance of his testimony.

1             This being put on the record, I would like to move into private

 2     session.

11             THE REGISTRAR:  Your Honours, we're now in open session.

12             JUDGE ORIE:  Thank you, Madam Registrar.

13             We were, for a while, in private session.  We'll now move into

14     closed session, and it's very difficult to forecast how long we will be

15     in closed session, whether that will be half an hour, or three quarters

16     of an hour, or whether that will be for days and days.

17             We move into closed session.

18                           [Open session]

19             THE REGISTRAR:  Your Honours, we're in open session.

20             JUDGE ORIE:  We moved into open session primarily to announce

21     that we would adjourn for the day.  At the same time, we are hearing at

22     this moment in private session the evidence given by Mr. Sacic, who was

23     called as a witness by the Chamber.  Very likely most of his evidence

24     will be given in private session but parts of his evidence to be heard

25     next week will be given in open session.

Page 27621

1             We adjourn for the day, and we will resume on Monday, the

 2     22nd of March, quarter past 2.00, Courtroom I.

 3                            --- Whereupon the hearing adjourned at 1.53 p.m.,

4                           to be reconvened on Monday, the 22nd day of March,

 5                           2010, at 2.15 p.m.
