 2                           [Open session]

 3                           [The accused entered court]

 4                           --- Upon commencing at 2.15 p.m.

5             JUDGE ORIE:  Good afternoon to everyone.

6             Madam Registrar, would you please call the case.

7             THE REGISTRAR:  Good afternoon, Your Honours.  This is case

8     number IT-06-90-T, the Prosecutor versus Gotovina, et al.

9             JUDGE ORIE:  Thank you, Madam Registrar.  If there are no

10     procedural matters to be raised, Ms. Mahindaratne, may I take it that you

11     want to continue your examination on subjects for which we'd have to move

12     into private session.

13             MS. MAHINDARATNE:  Yes, Mr. President.

14             JUDGE ORIE:  Then we move into private session, and the usher is

15     invited to escort the witness into the courtroom.

16             MS. MAHINDARATNE:  Mr. President while the witness is coming in,

17     I just wanted to inform the Court that I received --

22             MS. MAHINDARATNE:  I beg your pardon, Madam Registrar.

23             I just wanted to inform Court that I did check the evidence of

24     the citations I gave yesterday with regard to Witness 82, and I don't

25     find any inaccuracies that are cited.

1             JUDGE ORIE:  Is it about the Gracac --

2             MS. MAHINDARATNE:  Donji Lapac road, Mr. President.

3             JUDGE ORIE:  Yes.  I checked that as well.  What we see as a

4     matter of fact that the witness said that on their way to Donji Lapac

5     that he saw 90 per cent destroyed.  At other moments, he talks about

6     coming from Gracac but the direct link between the 90 per cent and the

7     route, Gracac-Donji Lapac, is not there, from what I see.  And that may

 8     have caused the objection.

9             MR. KUZMANOVIC:  That's correct, Your Honour, and that's the

10     point I was going to make after counsel graciously gave me the citations,

11     and I looked at them myself as well.

12             JUDGE ORIE:  Yes.  And so the 90 per cent is there, Donji Lapac

13     as a destination is there, Gracac, at another moment as where the -- they

14     departed from is there, but the 90 per cent for that trajectory from

15     Gracac to Donji Lapac is -- I haven't found it, and I have verified all

16     the quotations you gave.

17                           [The witness takes the stand]

18             MS. MAHINDARATNE:  Mr. President, if that's the case, my

19     apologies.
