I, Florence Ndepele Mwachande Mumba, the pre-trial judge in this case,

BEING SEIZED of the "Prosecution’s Application Seeking Authorization to Exceed the Page Limits of the Pre-Trial Brief", filed by the Prosecution on 1 October 2003 ("Application"), in which the Prosecution seeks to file the pre-trial brief pursuant to Rule 65ter(E)(i) exceeding the page limits as prescribed by the Practice Direction on the Length of Briefs and Motions,

CONSIDERING that the Prosecution shows exceptional circumstances necessitating such a filing,

PURSUANT TO Rule 54 and 65 ter of the Rules of Procedure and Evidence;

HEREBY order that the Prosecution is entitled to file the pre-trial brief which should not exceed 75 pages or 32.500 words, whichever is greater.
