THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

Proprio motu,

NOTING the oral instruction of the Trial Chamber of 8 March 2000 requiring the Office of the Prosecutor ("Prosecution") to submit to the Trial Chamber a document identifying those exhibits which, it is asserted, demonstrate the international character of the armed conflict in the region at the relevant of time of the indictment, and also identifying the particular parts of such documents on which they rely,

NOTING the submission made by the Prosecution in Annex 2 of its Response to the Defence Motion for Judgement of Acquittal, filed on 24 March 2000, listing the documents relating to the international character of the armed conflict upon which the Prosecution relies ("the Annex"),

NOTING also "Dario Kordic’s Response to Prosecution’s Submission Regarding International Armed Conflict" filed by the Defence for Dario Kordic on 7 April 2000,

NOTING that the Defence for Mario Cerkez has not filed any response to the Prosecution’s submission,

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the International Tribunal

HEREBY ORDERS as follows:

  1. the Prosecution shall, by Thursday 25 May 2000, file a copy of the exhibits listed in the Annex, duly marked to show the particular passages or portions of such documents upon which the Prosecution relies; and

  2. the Defence for Dario Kordic and the Defence for Mario Cerkez shall each have until Thursday 1 June 2000 to file any further submissions as to the issues in dispute.
