1. On 11 November 2003, the Prosecution filed a partially confidential "Prosecution’s Motion for Admission of Additional Evidence." The Prosecution seeks to present, as additional evidence under Rule 115 of the Rules of Procedure and Evidence of the International Tribunal, the evidence given by Mr. Miroslav Deronjic in the case of Prosecutor v. Nikolic, No. IT-02-60/1-S.

2. The evidentiary hearing in this appeal is scheduled for Friday, 21 November 2003. To enable the Appeals Chamber to properly consider the Prosecution motion prior to the evidentiary hearing, I HEREBY ORDER, pursuant to Rules 65ter(K), 107 and 127, that the Defence shall file its response to the Prosecution’s motion by 13:00, local Hague time, on Monday, 17 November 2003.
