THE APPEALS CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEIZED OF a motion entitled "Appeal of the Counsel of Zoran Kupreškic, Mirjan Kupreškic, Drago Josipovic and Vladimir Šantic Against the Decision of the Pre-appeal Judge Mohamed Bennouna from 29.6.00” (“the Motion”), filed on 30 June 2000, in which the Appellants request the Appeals Chamber to reconsider a decision made by the pre-appeal Judge on 29 June 2000,

NOTING the "Order on Motions for Extension of Time" issued by the pre-appeal Judge on 29 June 2000, which ordered that the deadline for the filing of the Appellant’s Brief of Vlatko Kupreskic be extended to 4 September 2000, and that the time-limit for the filing of the Briefs of the other Appellants remain unchanged,

NOTING the "Order Appointing a Pre-appeal Judge" issued by the Appeals Chamber on 16 May 2000,

CONSIDERING that the pre-appeal Judge was entrusted by the Appeals Chamber with the competence of determining all pre-appeal motions of a procedural nature with the power to refer to the Appeals Chamber any such motions as he considers appropriate, and that in this capacity the pre-appeal Judge therefore acts on behalf of the Appeals Chamber as a whole,

CONSIDERING further that the Appeals Chamber sees no legal grounds in this case for taking the extraordinary step of reconsidering the decision of the pre-appeal Judge,

HEREBY, REJECTS the Motion.
