Mr Krstan Simic for Miroslav Kvocka

I, Judge David Hunt, Pre-Appeal Judge,

NOTING the "Motion to Extention (sic) of Time for Filing the Appeal on Registrarís Decision Dated 08.07.2002" filed by Zoran Zigic ("Zigic") on 18 September 2002 ("Motion") in which Zigic seeks a further extension of time for the filing of his appeal against the Registrarís Decision of 8 July ("Decision");

CONSIDERING that investigations on behalf of Zigic were not authorised until 3 September and will not be completed until 19 September, and that the results of those investigations are material to the filing of the appeal;

CONSIDERING that par 16 of the "Practice Direction on Procedure for the Filing of Written Submissions in Appeal Proceedings Before the International Tribunal" (IT/155. Rev 1) allows the Appeals Chamber to grant a motion to extend a time limit upon a showing of good cause;

AND CONSIDERING that the delay in obtaining the results of the investigations demonstrates good cause;

HEREBY ORDER:

  1. The grant of an extension of time to Zigic until 1 October 2002 for the filing of his appeal against the Decision.

Done in English and French, the English text being authoritative.

Dated this 19th day of September 2002,
