SECOND DECISION ON FILING OF CONSOLIDATED RESPONDENTíS BRIEF
Counsel for the Prosecutor:
Mr Norman Farrell
Counsel for the Defence:
Mr Krstan Simic for Miroslav Kvocka
Mrs Jelena Nikolic for Milojica Kos
Mr Toma Fila for Mladjo Radic
Mr Slobodan Stojanoic for Zoran Zigic
Mr Jovan Simic for Dragoljub Prcac
1. On 22 April, and as Pre-Appeal Judge, I gave a decision rejecting an objection by the appellants Mladjo Radic ("Radic") and Dragoljub Prcac ("Prcac") to the filing of a Consolidated Respondentís Brief by the prosecution to the Appellantís Briefs filed individually by all five appellants1. The circumstances in which that objection was taken and the basis upon which the decision was given are sufficiently identified in the decision itself, and need not be repeated.
2. The following day, the appellant Miroslav Kvocka ("Kvocka") filed a similar objection2. He supports the objection made by Radic and Prcac3, but he adds nothing to their arguments. His objection is rejected, and the order sought by him is refused, for the reasons given in the Previous Decision. However, his objection will also be treated as a motion to reduce the time which the prosecution has in which to file its Consolidated Respondentís Brief, and that motion is deferred until the prosecution has filed the Memorandum which the Previous Decision has required it to file on or before 10 June 20024.
Done in English and French, the English text being authoritative.
Dated this 25th day of April 2002,
At The Hague,
Judge David Hunt
