THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the submission of an Amended Indictment by the Prosecution on 31 May 1999, pursuant to the "Decision on Defence preliminary motions on the form of the indictment" issued by the Trial Chamber on 12 April 1999,

NOTING the Scheduling Order of the Trial Chamber issued on 8 June 1999 requiring the Defence to file their submissions, if any, as to the changes reflected in the amended indictment by Thursday 17 June 1999,

BEING SEISED of a "Defence motion concerning the item 1 of the Order schedule of the Trial Chamber dated 8 June 1999" dated 17 June 1999 and filed on 18 June 1999 on behalf of the accused, Milojica Kos, ("the Motion"),

CONSIDERING the reason given in support of the Motion, that the Defence for the accused, Milojica Kos, has not received the amended indictment in the language of the accused, and therefore requests an extension of seven days from the date of receipt of the amended indictment in the language of the accused in which to file such submission,

CONSIDERING that the Motion was dated 17 June 1999 but was not received at the International Tribunal until after the close of business on 17 June 1999,

CONSIDERING the information provided to the Trial Chamber by the Registry of the International Tribunal that the amended indictment was provided to the Defence for the accused, Milojica Kos, in the language of the accused, on 30 June 1999,

CONSIDERING that it would be just to accept the Motion as validly filed,

PURSUANT TO Rule 127 of the Rules of Procedure and Evidence of the International Tribunal ("the Rules"),

HEREBY ORDERS AS FOLLOWS:

  1. the Defence for Milojica Kos shall have until Friday 9 July 1999 in which to file submissions, if any, as to the changes reflected in the Amended Indictment; and
  2. the Prosecution may file a further response, limited to that submission, by Friday 16 July 1999.
