DECISION

THE REGISTRAR,

CONSIDERING the Statute of the Tribunal as adopted by the Security Council under Resolution 827 (1993), as subsequently amended, and in particular Article 21 thereof;

CONSIDERING the Rules of Procedure and Evidence as adopted by the Tribunal on 11 February 1994, as subsequently amended, and in particular Rules 44 and 45 thereof;

CONSIDERING the Directive on Assignment of Defence Counsel (hereinafter "the Directive"), as subsequently amended, and in particular Articles 6, 8, 10, 11 and 18 thereof;

CONSIDERING that on 4 March 2003, Fatmir Limaj (hereinafter, "the accused") informed the Registry that he wishes to have Mr. Karim Khan, attorney at law from the United Kingdom of Great Britain and Northern Ireland, assigned to him as counsel;

CONSIDERING the decision of the Registrar dated 4 March 2003 assigning Mr. Khan temporarily as counsel to the accused for a period of 120 days in order to secure the rights of the accused while verifying his declaration of indigency;

CONSIDERING that the Registry does not possess sufficient information to make a determination of indigence;

CONSIDERING FURTHER that the Registry, on the basis of Articles 8 and 10 of the Directive and with a view to Article 18 thereof, will continue to investigate the financial status of the accused in order to determine whether he has sufficient means to pay for all or a portion of his defence;

CONSIDERING FURTHER the right of the accused to an effective defence before the International Tribunal;

HEREBY INVITES the accused to submit additional documentation to the Registry and in particular to confirm the official value of his immovable and movable properties;

DECIDES without prejudice to Article 18 of the Directive, to continue Mr. Khan’s assignment as counsel to the accused, effective as of 4 July 2003.
