I, Carmel Agius, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal") and Pre-Trial Judge in these proceedings:

BEING SEISED of the "Prosecution Request for an Extension of Time to File the Modifications to the Modified Consolidated Amended Indictment Pursuant to the Trial Chamber Decision of 20 July 2004" filed on 12 August 2004 ("Prosecution Request"), in which the Prosecution requests an extension of time to file the modifications to the Modified Consolidated Amended Indictment by no later than 30 August 2004;

NOTING the "Decision on the Form of the Modified Consolidated Amended Indictment" filed on 20 July 2004 ("Decision"), in which the Trial Chamber in the instant case ordered the Prosecution to file an amended indictment by 17 August 2004;

NOTING that the Prosecutor will not be physically in The Hague until 23 August 2004 and will therefore not be able to review and sign the amended indictment until that time;

NOTING that such a delay would not occasion any prejudice to any of the three accused in this case;

FINDING that good cause has been shown for enlarging the time limit prescribed by the Decision;

For the foregoing reasons,

PURSUANT TO Rule 127 of the Rules of Procedure and Evidence;

HEREBY ORDERS that the Prosecution file the modifications to the Modified Consolidated Amended Indictment by no later than 30 August 2004.
