THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("International Tribunal"),

NOTING its "Decision on Motion for Clarification and Joint Motion for Extension of Time" issued on 25 May 2001, which required, inter alia, all parties to file their briefs on sentencing by 22 June 2001,

NOTING the requirements of Practice Direction (IT/184) of 19 January 2001,

NOTING that the Practice Direction contains no specific provision governing the length of sentencing briefs but that it does provide that an appendix or book of authorities will be "of reasonable length, which is normally three times the page limit for that class of motion or brief",

NOTING that the brief filed on 22 June 2001 on behalf of Hazim Delic amounts to 26 pages, plus a cover page and four index pages, together with an appendix of 176 pages,

NOTING also that the Office of the Prosecutor has dealt with the issues relating to all three convicted persons in a 10-page submission and that the filings on behalf of the other convicted persons, Zdravko Mucic and Esad Landzo, are 15 pages each,

CONSIDERING therefore that the submission on behalf of Hazim Delic is unreasonably long,

HEREBY ORDERS as follows:

  1. the index pages of the brief (Registry pages 285-282) are rejected;
  2. the remaining pages of the brief (Registry pages 286 and 281-256) are admitted; and
  3. the appendix to the brief is returned unadmitted with leave for Hazim Delic to resubmit an appendix of a reasonable size, not to exceed 75 pages, within seven days.
