I, THEODOR MERON, President of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991 ("Tribunal"),

NOTING the "Sentencing Judgement" issued by Trial Chamber I on 2 December 2003;

NOTING “Momir Nikolic’s Notice of Appeal,” filed by counsel for the Appellant Momir Nikolic on 30 December 2003;

CONSIDERING the composition of the Appeals Chamber of the Tribunal as set out in Document IT/222, dated 17 November 2003;

CONSIDERING Articles 12(3) and 14(3) of the Statute of the Tribunal and Rule 27(C) of the Rules of Procedure and Evidence of the International Tribunal ("Rules");

NOTING Article 14(2) of the Statute of the Tribunal, which provides that the President of the Tribunal is ex officio the Presiding Judge of the Appeals Chamber;

CONSIDERING that Rule 65 ter of the Rules, read together with Rule 107 of the Rules, authorizes the Presiding Judge of the Appeals Chamber to designate a Member of the Appeals Chamber to be responsible for pre-appeal proceedings ("Pre-Appeal Judge");

HEREBY ORDER that in Case No. IT-02-60/1-A, Momir Nikolic v. The Prosecutor, the Appeals Chamber shall be composed, with immediate effect, as follows:

Judge Fausto Pocar

Judge Mohamed Shahabuddeen

Judge Mehmet Güney

Judge Inés Mónica Weinberg de Roca.

AND DESIGNATE, with immediate effect, Judge Mehmet Güney as Pre-Appeal Judge.
