[Open session]

[The accused entered court]

--- Upon commencing at 2.17 p.m.

JUDGE AGIUS: Good afternoon to you, Madam Registrar. If you

could call the case, please. And good afternoon to everyone.

THE REGISTRAR: Good afternoon, Your Honours. This is case number

IT-05-88-T, the Prosecutor versus Vujadin Popovic et al.

JUDGE AGIUS: Merci. All the accused are here.

The Defence teams, I think I only notice the absence of

Mr. Ostojic, although his team seems to be getting stronger and stronger

in conformity with the equality of arms rule.

For the Prosecution it's Mr. McCloskey and Ms. Janisiewicz. Since

I have pronounced that well, I understand that Mr. Bourgon has a

preliminary matter to raise. Mr. Bourgon?

MR. BOURGON: Good afternoon, Mr. President. Good afternoon,

Judges. Good afternoon, colleagues. Mr. President at this point in time

we would simply like to return to the issue that was raised yesterday

concerning the interview for which there were no audio recordings produced

by the Prosecution. Our colleague from the Prosecution did respond to us

by electronic means this morning, saying that -- maybe it's good if we go

into closed session, Mr. President.

JUDGE AGIUS: By all means. Let's go into closed session, please.
