 2                          [Open session]

 3                          [The accused entered court]

 4                          --- Upon commencing at 2.19 p.m.

5            JUDGE ANTONETTI: [Interpretation] Registrar, kindly call the case,

 6    please.

7            THE REGISTRAR:  Good afternoon, Your Honours.  Good afternoon

8    everyone in and around the courtroom and happy new year.  This is case

9    number IT-04-74-T, the Prosecutor versus Prlic et al.  Thank you, Your

10    Honours.

11            JUDGE ANTONETTI: [Interpretation] Thank you, registrar.  I would

12    also like to convey your new year wishes to all the people present in the

13    courtroom.  The team of the Prosecution that is here today in full force,

14    I'd like to greet you.  I'd like to greet Defence counsel, as well as the

15    accused, who unfortunately are very far removed because in this room the

16    accused are right at the back of the room.  The other courtroom, courtroom

17    III, is much more friendly-like.

18            As you know, we shall resume these proceedings today, we shall be

19    hearing a witness today for whom we will move into closed session, but

20    prior to that I need to hand down two very short oral decisions.

21            The first decision relates to the admission of Exhibit P 09848

22    that was tendered through Witness BC.  The Prosecution presented Exhibit

23    number P 09848 to Witness BC when the latter appeared before this court on

24    the 28th of November, 2007.  The Trial Chamber decided to admit Exhibit

25    number P 09848 under seal that had been requested by the Prosecution

Page 25739

1    through its list IC 00735 on the ground that this exhibit demonstrates

2    sufficient evidence, reliability, and probative value.

3            The second decision relates to the right to reply.  The Trial

4    Chamber would like to remind the parties that they expect to hear the

5    responses for two -- for three motions.  These are reply to the Defence

 6    motions.

7            In the event that the Prosecution would like, if the need arises,

8    to file the reply to these responses, the Trial Chamber requests that the

9    latter be in by the 9th of January, 2008.  In this way, the Trial Chamber

10    will be able to hand down its decision pending decisions well before the

11    24th of January, which is the date at which the Prosecution case comes to

12    an end.

13            Now, as far as the schedule for the month of January is concerned,

14    the Prosecutor has given you the list of all the witnesses who will be

15    coming over the next few weeks.  The Trial Chamber at this stage realises

16    that the 16th of January is a day for which we have nothing, and in the

17    week running from the 21st to the 24th of January there seems to be no

18    witness scheduled.  So I'm turning to Mr. Scott.  I would like him to

19    confirm this, please.

20            MR. SCOTT:  First of all, good afternoon, Mr. President, Your

21    Honours, welcome back after the new year and I'm sure I speak for everyone

22    in hoping that all of you had a very good and restful holiday.

23            As to the week of the 21st, if I can start with that and come back

24    to the 16th because I'm looking further -- look further at that for a

25    moment, on the week of the 21st, Your Honour, concerning that I think it's

Page 25740

1    best if we go into private session, please.

2            JUDGE ANTONETTI: [Interpretation] Registrar, could we go into

 3    private session, please.
