I, Carmel Agius, Presiding Judge of Trial Chamber II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("Tribunal");

CONSIDERING that the Trial Chamber will be in a better position to deal with and decide the Motion1 if it receives information on the state of detention of the Accused from the officials that are better placed than the Prosecution to inform the Trial Chamber about this matter;

CONSIDERING that complaints arising out of the application of the Rule of Detention are regulated in Rule 84-88 of the Rules of Detention and that each detainee" has the right to make written complaint, without censorship, to the Registrar, who shall forward it to the President" and that it is not clear if the Accused has made complaints to the President regarding the issues he raises in the Motion;

CONSIDERING HOWEVER that issue of whether the Accused’s rights to prepare his defence are being respected or not is a matter the Trial Chamber is seized of;

ORDERS the Registry and the Commanding Officer of the UNDU to file in public format their reactions to the allegations made by the Accused within 15 days from the filing of this order.
