 2                           [Open session]

 3                           --- Upon commencing at 2.25 p.m.

 4                           [The accused entered court]

5             JUDGE ANTONETTI: [Interpretation] Registrar, can you call the

 6     case, please.

7             THE REGISTRAR:  Thank you and good afternoon, Your Honours.

8             This is case number IT-03-67-T, the Prosecutor versus

 9     Vojislav Seselj.

10             JUDGE ANTONETTI: [Interpretation] The 3rd of February, 2009.  I'd

11     like to welcome the representatives of the Prosecution, Mr. Seselj, as

12     well as all the people assisting us in this courtroom.

13             We have started ten minutes late.  I shall send a memo to

14     Judge Orie, who was presiding in the Gotovina case.  It is unacceptable

15     not to stop on time when a new hearing starts at a quarter past 2.00.

16     I think one needs some discipline.  It's not the first time that this has

17     happened, and I feel that Judge Orie should make his own arrangements and

18     not finish late.  This means that we will have to now finish at a quarter

19     past 7.00.

20             I'm turning to the Prosecution.  In the course of the morning [as

21     interpreted], you told us that there would only be one witness for next

22     week.  I shall not give his name.  It's VS-1010.  You have planned him

23     for Thursday, the 12th of February.  Why can your Witness VS-1010 not

24     come sooner?

25             MR. MUNDIS:  Good afternoon, Your Honours.

Page 13818

1             Witness VS-1010 perhaps could be scheduled for Wednesday, but

2     certainly Witness 1029 doesn't have a valid passport, so my understanding

3     was that 1010 would prefer to come to testify on Thursday.  But if need

4     be, we can have that witness appear on Wednesday.  It was simply a

5     question of a witness preference in terms of the witness's scheduling and

6     availability, and so that's why he was scheduled for Thursday.

 7                           [Trial Chamber confers]

8             JUDGE ANTONETTI: [Interpretation] Mr. Mundis, the Trial Chamber

9     would like you to call your witness on Wednesday.  In case there is a

10     problem, it will be easier to resume on Thursday, rather than having him

11     come on the Thursday and asking him to stay over the weekend.  You have a

12     week to prepare this, and could you make sure that he comes on Wednesday,

13     if that is possible.

14             MR. MUNDIS:  Will do, Mr. President.

15             JUDGE ANTONETTI: [No interpretation]
