I, Judge Liu Daqun, Judge of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the former Yugoslavia since 1991 ("the International Tribunal"),

HAVING BEEN DESIGNATED as duty Judge by the President of the International Tribunal pursuant to Rule 28 of the Rules of Procedure and Evidence ("the Rules") for the period from 25 January 2002 until 1 February 2002;

NOTING the indictment submitted by the Prosecutor against Dusan Fustar and confirmed by Judge Lal Chand Vohrah, a Judge of the International Tribunal, on 20 August 1999, as amended on 24 August 1999, and as further amended on 3 January 2001;

NOTING the surrender of Dusan Fustar to the International Tribunal on 31 January 2002;

PURSUANT to Rule 28, Rule 54 and Rule 64 of the Rules;

HEREBY ORDER the detention of Dusan Fustar following his surrender, and instruct the Commander of the United Nations Detention Unit in The Hague to detain the Accused until further order.
