THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991 ("the International Tribunal"),

BEING SEISED of a "Motion for Access to Confidential Information" filed in Prosecutor v. Radoslav Brdjanin and Momir Talic, Case No. IT-99-36, on 12 July 2000 ("the Motion"), by counsel for the accused, Momir Talic, seeking access to all confidential exhibits and transcripts in this and other cases, such Motion having been forwarded to this Trial Chamber of the International Tribunal by the Registrar of the International Tribunal on 31 July 2000 at the invitation of Judge Hunt, pre-trial Judge in that case, for consideration pursuant to Rule 75 (D) of the Rules of Procedure and Evidence of the International Tribunal ("Rules"),

NOTING that the proceedings in this case are still at the pre-trial stage,

NOTING that the only exhibits that have been admitted in this case to date consist of documents accepted for pre-trial admission by the Trial Chamber on 1 August 2000, none of which are confidential,

NOTING that the only hearings held in closed session in this case at this stage relate to matters personal to the accused, such as the conditions of detention, which have been held in closed session for the protection of the interests of justice,

CONSIDERING that such material would not be "of significant value" to the accused, Momir Talic, in the preparation of his case,

PURSUANT TO Rules 75 (D) and 79 of the Rules,

HEREBY DENIES the Motion insofar as it relates to the case before this Trial Chamber and REQUESTS the Registrar of the International Tribunal to notify Trial Chamber II of this Decision.
