ORDER DESIGNATING A PRE-TRIAL JUDGE
The Office of the Prosecutor:
TRIAL CHAMBER I of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia Since 1991,
PURSUANT to Rule 65 ter of the Rules of Procedure and Evidence (hereinafter "the Rules"), adopted at the plenary session of the Judges on 9 and 10 July 1998;
CONSIDERING that Sub-rule 65 ter (A) states that the Trial Chamber may, at any time, designate from among its members a Judge responsible for the pre-trial proceedings;
CONSIDERING that, pursuant to Sub-rule 65 ter (B), the pre-trial Judge shall take any measure necessary to prepare the case for a fair and expeditious trial;
CONSIDERING that Sub-rule 65 ter (D) authorises the Trial Chamber to entrust the pre-trial Judge with all or part of any pre-trial functions set forth in Rules 73 and 73 bis of the Rules, as well as all or part of any pre-defence functions set forth in Rule 73 ter;
CONSIDERING that the Trial Chamber deems that the designation of a pre-trial Judge for the case The Prosecutor v. Milan Simic, Miroslav Tadic, and Simo Zaric (Case no. IT-95-9-PT) will permit the proceedings to be conducted more expeditiously and efficiently;
FOR THE FOREGOING REASONS,
DESIGNATES Judge Almiro Simões Rodrigues as the pre-trial Judge for the case The Prosecutor v. Milan Simic, Miroslav Tadic, and Simo Zaric (Case No. IT-95-9-PT), within in meaning of Sub-rule 65 ter (A) and ENTRUSTS him with all the functions set forth in Sub-rule 65 ter (D) of the Rules.
