THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),
NOTING the Trial Chamber’s Order Directing the Prosecution to Clarify its Position on the Admission of Defence Exhibits Tendered During the Kosovo Phase of the Prosecution Case ("the Order"), dated 8 October 2001,
NOTING the Prosecution’s Report to Clarify its Position on the Admission of Defence Exhibits Tendered During the Kosovo Phase of the Prosecution Case ("the Report"), filed on 15 October 2002,
NOTING the Trial Chamber’s Order on Prosecution’s Motion to Admit Documents Relating to Helena Ranta, filed on 13 November 2002, in which the issue of document D2 was addressed,
PURSUANT TO Rules 54 and 89 of the Rules of Procedure and Evidence of the International Tribunal,
HEREBY DECIDES as follows:
Document D5, as provided by the Prosecution in its Report, is admitted;
Documents D8, D23, D24, D25, D28, D30, D35, D36, D38, and D39 are admitted; and
Document D27 is not admitted, subject to clarification of the apparent discrepancy between the date of the document and the date of the fax.
