THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED OF a "Prosecution’s Request for Variation of an Oral Order of the Trial Chamber Regarding the Trial Schedule", filed on 1 October 2003 ("Request"), in which the Prosecution seeks an order that the Trial Chamber sit Tuesday, Wednesday and Thursday of each week, commencing 6 October 2003,

NOTING the Trial Chamber’s oral ruling on 30 September 2003 that, in light of medical advice concerning the Accused’s health, the Chamber would sit in this case on three days each week, giving the Accused four days of consecutive rest, and that in the week commencing 6 October, the Trial Chamber would sit from Monday to Wednesday,

CONSIDERING the submission of the Prosecution to the effect that for the benefit of the scheduling and preparation of Prosecution witnesses, it would be preferable if the Trial Chamber sat from Tuesday to Thursday each week, commencing Tuesday, 7 October 2003,

CONSIDERING that whilst the Trial Chamber accepts the Prosecution’s submission on this matter it is noted that there will have to be flexibility in the particular days on which the Chamber sits each week,

PURSUANT to Rule 54 of the Rules of Procedure and Evidence

HEREBY GRANTS THE REQUEST and ORDERS as follows:

  1. The Trial Chamber will sit in this case on Tuesday, Wednesday and Thursday, 7 – 10 October 2003;
  2. The Trial Chamber will generally sit thereafter on Tuesday to Thursday each week; and
  3. This sitting schedule shall be subject to variation by the Trial Chamber.
