THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of a confidential "Prosecution’s Report on Compliance with Trial Chamber Decisions in Relation to Rule 54bis and Application for Further Orders Pursuant to Rule 54bis", filed by the Prosecution on 31 October 2003 ("Motion"), requesting, inter alia, the Trial Chamber to issue binding orders upon the Government of Serbia and Montenegro ("Serbia and Montenegro") for the production of documentation,

NOTING that the Prosecution has not given Serbia and Montenegro notice of the Motion,

CONSIDERING that Rule 54bis(D)(i) of the Rules of Procedure and Evidence of the International Tribunal ("Rules") provides that, except in cases where a decision has been taken pursuant to paragraphs (B) or (C), the State concerned shall be given notice of the application,

CONSIDERING that the Trial Chamber has not yet taken a decision on the Motion pursuant to Rule 54bis(B) or (C) of the Rules,

CONSIDERING that the Trial Chamber would be assisted in the determination of the Motion by a response from Serbia and Montenegro,

PURSUANT to Article 29 of the Statute of the International Tribunal and Rule 54bis of the Rules,

HEREBY ORDERS as follows:

  1. The Prosecution shall give notice of the Motion to Serbia and Montenegro no later than 17 November 2003.
  2. Serbia and Montenegro shall file a response (if any) to the Motion no later than 01 December 2003.
