THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),

BEING SEISED of a confidential Prosecution motion for leave to call six witnesses, all of whom are identified therein, filed by the Office of the Prosecutor ("Prosecution") on 21 August 2002,

NOTING the Decision of the Trial Chamber of 28 August 2002 granting leave to the Prosecution to call one of the six witnesses, designated as K41,

NOTING that the Prosecution has not yet obtained statements from three of the witnesses,

CONSIDERING that the Trial Chamber is not satisfied on the information currently before it that it is in the interests of justice to permit the Prosecution to call the three witnesses for whom it has not yet obtained witness statements,

CONSIDERING that the Trial Chamber is satisfied that it is in the interests of justice to permit the Prosecution to call the witnesses identified in paragraphs 2 and 6 of the Motion,

PURSUANT TO Rule 73 bis of the Rules of Procedure and Evidence of the International Tribunal

HEREBY GRANTS leave for the Prosecution to call the two witnesses so identified and DENIES the balance of the Motion.
