THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the "Amended Croatia Indictment and Prosecution’s Motion for Further Variation of the Trial Chamber’s Order of 17 September 2002", filed by the Prosecution on 23 October 2002, Appendix A of which is an Amended Croatia Indictment,

CONSIDERING that the Amended Croatia Indictment is produced in accordance with Orders of the Trial Chamber dated 17 September and 25 September 2002,

CONSIDERING FURTHER that the sole changes to the Indictment are reductions in the allegations contained in paragraph 36 dealing with the charge of Persecution pursuant to Article 5(h) of the Statute of the International Tribunal,

PURSUANT TO RULE 50 of the Rules of Procedure and Evidence of the International Tribunal

HEREBY GRANTS LEAVE TO AMEND THE INDICTMENT AND ORDERS that the Amended Croatia Indictment is the operative indictment for the purposes of the Croatia part of the proceedings.
