THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("the International Tribunal"),
BEING SEISED of a "Prosecution’s Motion to Admit Documents Relating to Helena Ranta" filed by the Office of the Prosecutor ("Prosecution") on 15 October 2002 ("the Motion"), in which the Prosecution seeks the admission of a press interview with Helena Ranta, a forensic scientist, and a letter written by her commenting on the interview, addressing a forensic report conducted after the events at Racak in January 1999,
NOTING the observations filed by the Prosecution on 15 October 2002, commenting on, inter alia, the document marked for identification as Defence Exhibit D2, which document also addresses the forensic reports conducted after the events at Racak in January 1999,
NOTING the observations on the Motion raised by the amici curiae in a filing of 1 November 2002,
CONSIDERING that the Trial Chamber is of the view that the materials proffered by both the Prosecution in the Motion and by the accused in the document marked for identification as Defence Exhibit D2 do not assist the Trial Chamber in determining the reliability and probative value of the material already before it,
CONSIDERING that the Trial Chamber wishes to hear the evidence of Helena Ranta in person,
PURSUANT TO Rules 89 and 98 of the Rules of Procedure and Evidence of the International Tribunal,
HEREBY DENIES the Motion and ORDERS as follows:
