THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the confidential "Prosecution’s Submission on the Possibility of Agreeing Certain Facts Put to the Witnesses by the Accused", filed by the Prosecution on 5 November 2002 ("Prosecution Submission"), in which the Prosecution, responding to the Trial Chamber’s Order that it consider whether it could agree to some of the facts being put by the accused to witnesses, stated that:

  1. Having reviewed the cross-examination by the accused of C-04 as an example, the accused puts a wide range of propositions that cannot easily be consolidated into issues upon which the Prosecution could seek agreement;
  2. There would, therefore, be no time saved by requiring the Prosecution to investigate whether or not the facts asserted by the accused are correct and could be agreed; and
  3. It would be pleased to create a chronology of events to be put to the accused or his associates with an eye to developing an agreed position,

CONSIDERING that it would be helpful to have such a chronology referred to and for the Prosecution to endeavour to obtain agreement from the accused to it,

PURSUANT TO RULE 54 of the Rules of Procedure and Evidence of the International Tribunal

HEREBY ORDERS the Prosecution to file a chronology, as referred to in paragraph 4 of the Prosecution Submission, by 28 November 2002 and that it seeks to obtain the agreement of the accused to it.

Done in English and French, the English text being authoritative.
