THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the Order of the Trial Chamber of 30 August 2001inviting the Registrar of the International Tribunal to designate counsel to appear before it as amicus curiae, the designation by the Registrar on 6 September 2001 of Mr. Steven Kay, Mr. Branislav Tapuskovic and Mr. Michaïl Wladimiroff as amicus curiae, and the Decision of the Trial Chamber of 10 October 2002 instructing the Registrar to revoke the designation of Mr. Michaïl Wladimiroff as amicus curiae,

CONSIDERING that, in the view of the Trial Chamber it would be in the interests of securing a fair trial for a third amicus curiae with expertise in international law to be appointed pursuant to Rule 74,

HEREBY DESIGNATES Mr. Timothy McCormack of Melbourne, Australia, to appear before it as amicus curiae, to assist the Trial Chamber by:

  1. making written submissions on, and appearing before it to address, questions of international law as and when requested by the Trial Chamber; and
  2. drawing to the attention of the Trial Chamber relevant issues of international law,

DIRECTS the Registrar to provide Mr. McCormack with all such material as is or has been provided to the accused.
