THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEIESED OF a "Prosecution Motion for a Hearing to Discuss the Implications of the Accused’s Recurring Ill Health", filed on 23 September 2003 ("Motion"), in which the Prosecution submits that the Trial Chamber should consider a flexible approach to the admission of evidence in the absence of the Accused, as well as the possibility of varying the trial sitting hours and revisiting the question of representation of the Accused,

CONSIDERING that it is necessary, for the Trial Chamber to properly consider the proposals of the Prosecution, that it receive submissions on the legal basis for the proposals contained in the Motion,

CONSIDERING FURTHER that it would be appropriate thereafter to hear oral submissions on the matters raised,

PURSUANT to Rule 54 of the Rules of Procedure and Evidence

HEREBY ORDERS AS FOLLOWS:

  1. The parties, including the amici curiae, shall file submissions on the legal basis for the proposals made by the Prosecution in the Motion by Monday, 29 September 2003; and
  2. The Trial Chamber shall hear oral submissions of the parties with respect to these matters on Tuesday, 30 September 2003 at 9am.
