THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

Proprio motu

NOTING the confidential witness lists filed periodically by the Prosecution,

CONSIDERING that after 250 days of hearing and 19 months of trial, and after hearing 244 witnesses,1 the Prosecution has still not produced a definitive witness list stating who the witnesses are it intends to call for the remainder of its case,

PURSUANT to Rule 54 of the Rules of Procedure and Evidence

HEREBY ORDERS AS FOLLOWS:

  1. The Prosecution shall produce, within 21 days, a definitive witness list, setting out the names of the witnesses it intends to call for the remainder of the Prosecution case; and
  2. The list may include confidential and/or ex parte schedules in order to protect witnesses.
