THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED of "Amicus Curiae’s Request for Separation of and Extension of Time for the Filing of Written Submissions", filed by the amicus curiae, Professor McCormack on 3 November 2003 ("Request"), in which he requests permission to separate the written submissions for self-defence as it arises in the Croatia part of the case from those for the Bosnia-Herzegovina part of the case and for an extension of time in which to file those submissions,

NOTING the Order of the Trial Chamber on 23 July 2003 requesting written submissions from the amicus curiae on international law matters in relation to self-defence as it has arisen in the Croatia and Bosnia-Herzegovina parts of the case,

CONSIDERING that the Prosecution will complete its case in 32 trial days, most likely in the middle of February, and that the amici curiae will seven days thereafter file a motion for judgement of acquittal pursuant to Rule 98 bis,

PURSUANT TO Rules 54 and 74 of the Rules of Procedure and Evidence

HEREBY ORDERS AS FOLLOWS:

  1. Professor McCormack may file his written submissions on self-defence as it arises in the Croatia part of the case separately from those for the Bosnia-Herzegovina part of the case;
  2. The written submissions on self-defence in the Croatia part of the case shall be filed no later than 11 February 2004; and
  3. The written submissions on self-defence in the Bosnia-Herzegovina part of the case shall be filed no later than 25 February 2004.
