THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

Proprio motu

NOTING the following procedural history with respect to Carl Bildt:

  1. "Decision on Prosecution’s Fourth Omnibus Motion for Leave to Amend the Witness List and Request for Protective Measures", issued 21 November 2003, granting the Prosecution permission to add Carl Bildt ("witness") to its list of witnesses;

  2. "Order on Prosecution’s Request Concerning the Testimony of B-1731", issued 16 January 2004, denying the Prosecution’s request to admit into evidence a statement of the witness under Rule 89(F) of the Rules of Procedure and Evidence of the International Tribunal ("Rules"); and

  3. "Decision on Prosecution’s Second Application Under Rule 89 (F) to Receive the Evidence-in-Chief of Witness Carl Bildt in Written Form", issued 29 January 2004, granting the Prosecution’s second request to admit into evidence the statement of the witness under Rule 89(F) of the Rules,

NOTING that Rule 98 of the Rules provides that the Trial Chamber may proprio motu summon witnesses and order their attendance,

CONSIDERING that it would assist the Trial Chamber to receive the evidence of the witness and that it is appropriate for the Trial Chamber to call the witness under Rule 98 of the Rules,

PURSUANT to Rule 98 of the Rules,

HEREBY SUMMONS and ORDERS the attendance of Carl Bildt to give evidence before the Trial Chamber in the present matter and will ISSUE further orders with respect to this matter in due course.
