THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING that on 12 March 2004, the Presiding Judge reported to the President of the International Tribunal that by reason of Judge May’s illness leading to his resignation, Judge May was unable to continue sitting in the Milosevic case,

NOTING that at a hearing on 25 March 2004, the President, pursuant to
Rule 15 bis (C) of the Rules of Procedure and Evidence of the International Tribunal ("Rules"), sought the consent of the Accused to the continuation of the proceedings with a substitute Judge, and that the Accused did not consent,

CONSIDERING that, taking all the circumstances into account, it is in the interests of justice to continue the proceedings before this Trial Chamber with a substitute Judge,

Pursuant to Rule 15 bis (D) of the Rules

The remaining Judges unanimously DECIDE to continue the proceedings in the Milosevic case with a substitute Judge.
