THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING with respect to Exhibit 641, tendered through witness Hrvoje Šarinić (“witness”), that the Trial Chamber has into evidence admitted tabs 2 and 4 (his Rule 89 (F) statements admitted in a decision dated 18 December 2003); tabs 9, 14, 16 and 19 (intercepts that were admitted in a Decision dated 11 March 2004), and tabs 37, 38 and 39 (admitted under seal),

NOTING that tabs 6, 7, 8, 10, 11, 12, 13, 15, 17 and 18 (intercepts not capable of authentication by the witness) were excluded by the Trial Chamber in a decision dated
11 March 2004,

NOTING FURTHER that tabs 1, 3, 5 and tabs 20 to 36 of Exhibit 641 were not formally admitted into evidence during the testimony of the witness, but that it was the intention of the Trial Chamber to do so,

CONSIDERING that both parties make reference to some of these documents in their Rule 98 bis pleadings, indicating their assumption that these documents were admitted into evidence,

CONSIDERING that it is appropriate to make it clear that the Trial Chamber’s intention was to admit these documents into evidence and by this Order formally does so,

PURSUANT TO Rules 54 and 89 of the Rules of Procedure and Evidence of the International Tribunal

HEREBY ORDERS that tabs 1, 3, 5 and tabs 20 to 36 of Exhibit 641 be formally admitted into evidence.
