THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

BEING SEISED OF a "Prosecution Application to Modify the ‘Second Order Granting Leave to Amend the Croatia Indictment’, and to Permit the Prosecution to File a Second Amended Croatia Indictment", filed 26 July 2004 ("Motion"), in which the Prosecution seeks the inclusion of amendments to the body of the Croatia Indictment consequential on amendment to Annex 1 thereof, as amended by the Trial Chamber’s "Second Order Granting Leave to Amend the Croatia Indictment", issued on 20 July 2004, and seeking for the Second Amended Indictment attached to the Motion to be filed as the operative Croatia Indictment,

CONSIDERING that the proposed modifications are merely consequential upon amendment of Annex 1 to the Croatia Indictment, which the Trial Chamber has granted,

PURSUANT TO Rule 50(A)(i)(c) of the Rules,

HEREBY ORDERS AS FOLLOWS:

  1. The Prosecution is granted leave to further amend the Amended Croatia Indictment.
  2. The Trial Chamber modifies its Second Order Granting Leave to Amend the Croatia Indictment.
  3. The Second Amended Indictment, as attached to the Motion, shall be the operative Second Amended Indictment for the Croatia part of the case.
