ORDER GRANTING ACCESS TO CONFIDENTIAL MATERIAL FOR PURPOSE OF INDEPENDENT AUDIT

THE TRIAL CHAMBER,

CONSIDERING the order of the President of the Tribunal issued on 6 April 2006, appointing this Trial Chamber to consider the question of varying or lifting the protective measures granted with regard to certain materials filed in the Milosevic case for purposes of granting access to those materials to the independent auditors appointed by the Government of Sweden upon the Registrar’s request of 20 March 2006;

CONSIDERING that the Trial Chamber understands "certain materials" to mean any material filed confidentially in the Milosevic case that might be relevant to the independent audit, including all material arising from the "Order Concerning the Preparation and Presentation of the Defence Case" issued by Trial Chamber III on 17 September 2003, as well as internal memoranda by the Registrar referring to any material filed confidentially ("relevant material");

CONSIDERING that the Trial Chamber, as noted in its Order of 16 March 2006, has informed itself about the range of possible relevant materials, and that it has consulted the judges of Trial Chamber III about the general reasons which led that Chamber to grant confidential status to such materials;

CONSIDERING the interest of the Tribunal and the public in an independent audit regarding the governance, management, and administration of the Detention Unit, with specific regard to the situation of Slobodan Milosevic, as well as the need for the independent auditors, in order to complete their task, to have access to the relevant material;

PURSUANT to Rule 54 of the Tribunal’s Rules of Procedure and Evidence,

ORDERS that:

1. For the purposes of the independent audit, the Registrar shall grant the independent auditors full access to the relevant material;

2. Notwithstanding the previous paragraph, all relevant materials in the Milosevic case file, as well as any other related documents disclosed by the Registrar, shall remain confidential.
