THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

Proprio motu

BEING SEISED of a "Motion for Joinder" filed by the Office of the Prosecutor ("Prosecution") on 27 November 2001 ("the Motion"), seeking a joint trial for the accused on the three indictments in these cases,

NOTING the Order of the Trial Chamber of 23 November 2001 scheduling oral argument on any such motion for Tuesday 11 December 2001,

PURSUANT TO Rule 54 and 73 of the Rules of Procedure and Evidence of the International Tribunal

HEREBY INSTRUCTS the parties to address the Chamber, inter alia, on the following issues in relation to the Motion:

(1) the theory of responsibility of the accused with respect to each indictment;

(2) the number of witnesses expected to be called for each case;

(3) the number of exhibits expected to be tendered in each case;

(4) the time anticipated for preparation for trial in each case;

(5) the expected length of trial if each case is tried separately; and

(6) the expected length of trial if a joint trial is ordered.
