THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the Decision of the Appeals Chamber of 1 February 2002,

PURSUANT TO Rule 54 of the Rules of Procedure and Evidence of the International Tribunal ("the Rules"),

HEREBY ORDERS as follows:

(1) the trial shall commence on Tuesday 12 February 2002 with evidence relevant only to the charges relating to Kosovo being adduced until it becomes appropriate to adduce evidence also relevant to the charges relating to Croatia and Bosnia;

(2) the Prosecution shall by noon on Thursday 7 February 2002 confirm that the order of witnesses for the trial remains unchanged or file an amended order of witnesses by that time, subject always to the existing Orders as to disclosure of witness statements and identities;

(3) the Trial Chamber will sit from 9.30 a.m. to 4 p.m. for the first four weeks of the trial;

(4) in her opening address the Prosecutor may give a general outline of her case in relation to all the charges in order to clarify the case and to assist the Trial Chamber in its understanding of matters of relevance;

(5) the Trial Chamber will determine what adjournments are appropriate for the preparation of the trial on the charges relating to Bosnia and Croatia in order to safeguard the rights of the accused and to ensure a fair and expeditious trial;

(6) in any event, the Prosecution is to be ready for trial on those charges by 1 July 2002;

(7) subject to any orders for protective measures that may be made, the Prosecution shall complete disclosure of all witness statements pursuant to Rule 66 (A)(ii) of the Rules by Tuesday 2 April 2002;

(8) the Prosecution shall submit its pre-trial brief and its lists of witnesses and exhibits by Tuesday 2 April 2002; and

(9) both the Prosecution and the accused shall have the opportunity to present such further opening statements addressing the charges relating to Bosnia and Croatia at a time which the Trial Chamber determines to be appropriate.
