THIS TRIAL CHAMBER of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal"),

NOTING the indictment in the Croatia part of these proceedings, confirmed by Judge Rodrigues on 8 October 2001, and the indictment in the Bosnia part of these proceedings, confirmed by Judge

May on 22 November 2001,

NOTING that subsequent to the confirmation of these indictments and during the pre-trial stages of these parts of the case, the Prosecution has indicated a reduction in the scope of its case against the accused in a number of respects, including the following:

  1. The Prosecution will not, contrary to allegations in the Bosnia indictment, seek to prove that genocide was committed in relation to the Bosnian Croat population;
  2. The Prosecution has indicated 20 locations in the Bosnia indictment it intends to lead limited evidence on; has stated that it will not be leading any evidence on nine municipalities, and the Trial Chamber has further indicated the need for it to reduce the breadth of its case; and
  3. The Trial Chamber has indicated that there should also be a reduction in the breadth of the Prosecution case with respect to the Croatia indictment,

CONSIDERING that only the Prosecution knows the extent to which it will not lead evidence either in respect of certain charges or in respect of certain locations or municipalities in the two indictments,

CONSIDERING that it would be of benefit to the accused and to the Trial Chamber for the indictments to reflect these and any other reductions in the Prosecution’s case against the accused,

PURSUANT TO RULE 54 of the Rules of Procedure and Evidence of the International Tribunal

HEREBY ORDERS THE PROSECUTION TO:

  1. Amend the Croatia and Bosnia indictments so as to clarify and bring them into line with the stipulations made by the Prosecution with respect to the reduction of the case against the accused during the pre-trial stage of these proceedings; and
  2. File the amended indictments by the commencement of the Croatia and Bosnia parts of these proceedings, being 26 September 2002.
