TRIAL CHAMBER II of the International Tribunal for the Prosecution of Persons Responsible for Serious Violations of International Humanitarian Law Committed in the Territory of the Former Yugoslavia since 1991 ("International Tribunal");

NOTING that due to the unavailability of Judge Fassi Fihri as a result of illness it is not possible to hear the case of Prosecutor v Milomir Stakic on Friday 6 September 2002 and Monday 9 September 2002;

NOTING that under Rule 15bis of the Rules of Procedure and Evidence ("the Rules") the remaining judges of the Chamber may order that the hearing of the case continue for a period of not more than three days if "satisfied that it is in the interests of justice to do so";

NOTING that under Rule 65bis of the Rules a permanent Trial Chamber Judge shall convene a status conference "to review the status of his or her case and to allow the accused the opportunity to raise issues in relation thereto";

HEREBY ORDERS that:

- the hearing on Monday 9 September 2002 be cancelled;

- a status conference be held at 09.30 on Monday 9 September 2002 in Courtroom II;

- the hearing resume on Tuesday 10 September 2002 at 09.30 and continue as scheduled until further notice;

- the conclusion of the Prosecution case be moved to Tuesday 24 September 2002;

- the trial be scheduled for 09.00 to 13.45 on Tuesday 24 September 2002 as the envisaged hearings that day in another case have been cancelled;

AND RECALLS that the deliberations scheduled for 25 September to 27 September 2002 remain as scheduled and are aimed at streamlining the case and limiting any upcoming motions and decisions as regards both facts and law to what is strictly necessary.
